1. Acceptance of Terms

Welcome to Uncaged ("Platform", "we", "us", "our"). By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

We reserve the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

2. Eligibility

You must be at least 18 years old to use this Platform. By using Uncaged, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You are not prohibited from using the Platform under applicable laws
• All information you provide is accurate and truthful

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Prohibited Content

Absolutely Prohibited:

• Child Sexual Abuse Material (CSAM) - Any sexual or exploitative content involving minors. This includes real, animated, or AI-generated content. Violations will be reported to NCMEC and law enforcement.
• Non-consensual intimate content - Sexual content shared without the consent of all parties depicted
• Human trafficking or exploitation - Content promoting or facilitating trafficking
• Terrorism or violent extremism - Content promoting terrorist organizations or extreme violence
• Direct threats of violence - Credible threats against individuals or groups

Also Prohibited:

• Content that infringes on copyrights or trademarks without authorization
• Malware, viruses, or harmful code
• Spam, phishing, or deceptive content
• Doxxing or sharing private personal information
• Impersonation of others
• Content that violates any applicable law

5. Adult Content Policy

Uncaged permits adult content with the following requirements:

• All individuals depicted must be 18 years or older
• All content must be consensual
• Creators must verify their age and identity
• Content must be properly tagged and categorized
• Creators are responsible for obtaining necessary releases and permissions

6. Content Reporting

We take content violations seriously. Users can report content that violates these Terms using the Report button on any video. We will:

• Review all reports promptly
• Remove content that violates our policies
• Take appropriate action against violating accounts
• Report illegal content to appropriate authorities
• Cooperate with law enforcement investigations

7. Creator Monetization & Revenue

Creators on Uncaged can monetize their content through subscriptions, tips, and pay-per-view content.

Revenue Split:

• Standard revenue split is 85% to Creator / 15% to Uncaged
• Uncaged reserves the right to offer custom revenue arrangements at its sole discretion
• Revenue splits may vary based on promotional programs, creator tier, or individual agreements
• Payment processing fees may apply and will be disclosed

Creator Referral Program:

• Creators may earn 5% of revenue from creators they directly refer
• Referral earnings are limited to 12 months from the referred creator's sign-up date
• Referral earnings are single-level only (no earnings from indirect referrals)
• Uncaged reserves the right to modify or discontinue the referral program at any time

Payouts:

• Minimum payout threshold: $50
• Payouts processed monthly
• Creators must provide valid payment information
• Creators are responsible for their own taxes

8. Intellectual Property

You retain ownership of content you upload. By uploading content, you grant Uncaged a non-exclusive, worldwide, royalty-free license to:

• Host, store, and display your content
• Distribute your content through our Platform
• Create thumbnails and previews
• Promote your content on and off the Platform

You represent that you own or have the necessary rights to all content you upload.

9. DMCA & Copyright

We respect intellectual property rights. If you believe content infringes your copyright, submit a DMCA takedown notice to dmca@uncaged.com with:

• Identification of the copyrighted work
• Identification of the infringing material and its location
• Your contact information
• A statement of good faith belief
• A statement of accuracy under penalty of perjury
• Your physical or electronic signature

10. Limitation of Liability

To the maximum extent permitted by law:

• Uncaged is provided "as is" without warranties of any kind
• We are not liable for user-generated content
• We are not liable for indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid us in the past 12 months

11. Indemnification

You agree to indemnify and hold harmless Uncaged, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your use of the Platform
• Your content
• Your violation of these Terms
• Your violation of any third-party rights

12. Termination

We may suspend or terminate your account at any time for:

• Violation of these Terms
• Illegal activity
• Fraudulent or abusive behavior
• Extended inactivity
• Any reason at our sole discretion with notice

Upon termination, your right to use the Platform ceases immediately.

13. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Texas.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
